United States President Donald Trump has signed a new executive order introducing penalties for individuals who burn or desecrate the American flag.
In a statement released by the White House on Monday, President Trump described the American flag as one of the nation’s most important symbols, representing identity, freedom, and strength.
“Our great American flag is the most sacred and cherished symbol of the United States of America, and of American freedom, identity, and strength. Over nearly two-and-a-half centuries, many thousands of American patriots have fought, bled, and died to keep the Stars and Stripes waving proudly,” Trump said.

The president emphasized that the flag should be a unifying emblem for all Americans, regardless of differences in background or belief.
“The American flag is a special symbol in our national life that should unite and represent all Americans of every background and walk of life,” he added.
The executive order recognizes the American flag as one of the country’s most enduring national symbols. It warns that acts of desecration could incite hostility or violence and references Supreme Court rulings on First Amendment protections. However, it also notes that the Court has not ruled flag burning likely to provoke imminent lawless action or considered as “fighting words” to be constitutionally protected.
The directive authorizes the Attorney General to enforce criminal and civil laws against acts of flag desecration, particularly in cases involving violent crimes, hate crimes, civil rights violations, or property damage. Federal agencies are also instructed to refer such incidents to state or local authorities when necessary.
In addition, the order empowers the Secretary of State, the Attorney General, and the Secretary of Homeland Security to deny or revoke visas, residency, naturalization, or other immigration benefits for foreign nationals found guilty of flag desecration. It also allows for their removal from the country where legally permissible.
The order took effect immediately upon signing. It further states that if any section is declared invalid, the remaining provisions will continue to be enforced.
