A Federal High Court in Abuja has refused to hear the application by the detained leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, seeking an order for his transfer from the custody of the Department of State Services (DSS) to the National Hospital, Abuja, for urgent medical care.
Justice Mohammed Liman on Monday refused to hear Kanu’s application following the expiration of the vacation period of the court.
Consequently, the judge returned the case file to the chief judge for reassignment to another judge.

The motion, which was brought by Kanu’s counsel, Kanu Agabi (SAN), on September 3, followed, what he said, was the result of a medical test by a team of doctors led by Prof. Austin A.C. Agaji, which in August showing that Kanu was suffering from kidney and liver-related issues, dangerously low potassium levels, and a swelling under his armpit requiring urgent medical investigation.
Justice Liman had earlier granted leave to hear the motion during the vacation due to its urgency and directed the lawyer to serve the processes on the DSS.
Kanu is facing seven-count charges before the court on charges related to terrorism and treasonable felony, which is set to continue before Justice James Omotosho on October 10.
The federal government had, in June 2021, arrested and renditioned Kanu from Kenya after he allegedly jumped bail in 2017 during a military raid on his residence in Abia State.
