In a decisive judgment delivered on November 6, 2025, Hon. Justice Egwuatu of the Federal High Court, Abuja, dismissed the suit filed by Adekunle Rufai Omoaje and affirmed Chief Kenneth Udeze as the lawful National Chairman and the head of the valid National Executive Committee of the Action Alliance (AA).

The case, marked FHC/CS/12/2024, was instituted by Adekunle Omoaje and his faction, seeking the court’s recognition of their own leadership and the national convention they claimed to have held in Abeokuta, Ogun State, as the authentic and legitimate one.

After reviewing the arguments presented by Ezenwa Ibegbunam, counsel to Chief Udeze, and examining several past judicial decisions on the matter, the court ruled in favour of Udeze’s camp. Justice Egwuatu held that Omoaje’s claims lacked merit and accordingly dismissed the suit in its entirety.

This ruling effectively brings to a close the protracted leadership crisis that had plagued the party, paving the way for the Action Alliance to refocus its energy on participating in forthcoming elections across the country.

Reacting to the verdict, Chief Kenneth Udeze hailed the judgment as a clear victory for the rule of law and a complete vindication of his leadership. He said the court’s decision had “finally laid to rest the illegal and fictitious claim of Omoaje over the party leadership.”

Chief Udeze also expressed appreciation to the Independent National Electoral Commission (INEC) for its consistent adherence to due process and respect for the rule of law in managing the party’s leadership matters.
