The leadership of the Social Democratic Party in Akwa Ibom state, which is the plaintiff in the suit, is alleging that the local government elections, conducted by the Akwa Ibom State Independent Electoral Commission, AKISIEC, on December 5, 2024, should be set aside for alleged irregularities bordering on violation of the Electoral Act and Constitutional provisions.
Counsel for the 1st and 2nd defendants in the matter, Barr. Otu Otu, representing AKISIEC and the Akwa Ibom State Attorney General, has told the Court that the Party in contention (SDP) lacks the locus standi to challenge the said election, as it did not partake in the exercise in the first place, to warrant any legal action.

However, Aderemi Abimbola, Counsel for SDP(defendants), was not in court when the adoption date was fixed by the Presiding Judge, C.S.Onah of the Federal High Court, Uyo.
